1. Agreement to Terms
By accessing or using the services provided by Apex Frame Systems LLC (“Apex Frame,” “we,” “us,” or “our”), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services.
2. Services
Apex Frame provides concierge proposal drafting services for civil and infrastructure contractors pursuing public and private solicitations. Specific services, deliverables, turnaround times, and fees are defined in individual engagement agreements.
3. Professional Standards
Drafts are produced by an Engineer-in-Training (EIT) and AI-assisted tools to support, not replace, the professional judgment of the client firm. Clients retain full responsibility for reviewing, revising, and approving every deliverable before submission under their firm's name and signatures. No deliverable is a stamped engineering document.
4. Client Materials & Intellectual Property
Client-provided materials (RFPs, past projects, personnel information, firm collateral) remain the property of the client. Upon delivery and full payment, clients receive the final proposal draft and all derivative work product produced for that engagement. Apex Frame retains rights to underlying drafting methodologies, templates, and process frameworks.
5. Guarantee & Refunds
If a delivered draft is not worth what was paid, notify us and we will revise until it is, or refund the fee. Proposal awards are decided by the soliciting agency, and no award outcome is guaranteed.
6. Limitation of Liability
To the maximum extent permitted by law, Apex Frame Systems LLC shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability shall not exceed the fees paid in the three months preceding the claim.
7. Governing Law
These Terms are governed by the laws of the Commonwealth of Pennsylvania. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
